Kraus Law Group Secures Win in Case Involving Pediatric Multiple Sclerosis
We are pleased to share that earlier this year, we secured an important win on behalf of a child who developed symptoms of Multiple Sclerosis ("MS"), a serious neurologic disease, following the receipt of a meningococcal vaccine.
We initially filed a Petition in the Vaccine Injury Compensation Program in 2020 and asserted that the vaccination had either triggered, or significantly worsened, a pre-existing but asymptomatic MS.
At the time of vaccination, our client was a healthy appearing 13-year-old. Within a few weeks, our client developed neurologic symptoms, including headache, leg weakness and numbness/tingling that ultimately led to hospitalization. After further investigation, our client was diagnosed with MS after imaging revealed lesions in the brain. Thankfully, our client has done well on medication, though continues to experience periodic neurologic symptoms.
In prosecuting the case, we engaged an expert neuro-immunologist who testified at an entitlement hearing and explained how the meningococcal vaccine likely led to the subsequent neurologic symptoms. Attorneys Edward Kraus and Brynna Gang represented our client at the hearing.
In a decision from 2026, the presiding Special Master found that the meningococcal vaccination did lead to a significant worsening of a pre-existing, but quiescent MS. That decision means that our client will receive compensation for a life-changing vaccine injury and symptoms that will last throughout life. We are presently in the damages phase of the case which will determine the compensation our client receives, likely to include damages for pain and suffering, out of pocket medical costs, and future medical care.
