Damages Award for an Injured Child Ensures Lifelong Financial Support
After years of advocacy, we are pleased to report that one of our long-time client’s was recently awarded compensation that will allow her to have the support she needs for the rest of her life.
Our client developed a seizure disorder following her 9-month-old vaccinations. After multiple seizures, some requiring hospitalization, she was diagnosed with epilepsy and global developmental delay after her family witnessed developmental regression.
We filed a case in the Vaccine Injury Compensation Program (VICP) alleging that the vaccines our client received triggered her seizure disorder which ultimately led to, and/or worsened, her developmental regression and delay.
Initially, the Special Master (a/k/a Judge) denied our client’s case, and attorney Ed Kraus appealed the decision, arguing that the special master had made legal errors in deciding the case.
Ultimately, that appeal was successful and in a prior blog post, we discussed that our client has been found entitled to compensation, meaning that she would receive the funding necessary for her to be supported throughout her life. You can read about that here.
Now, after an involved negotiation process, we are pleased to report that our client has been awarded a significant compensation package.
Our client was awarded:

A lump sum of $1,537,438.76, plus
-
An annuity contract to pay for future care and paid out over her lifetime, totaling many millions of dollars
This award means that our client, and her family, will be able to provide for her needs for the rest of her life.
We are so appreciative that our client’s family put their trust in us to work for them to obtain this result.
This case involved years of work before there was even a hearing before the Special Master, followed by shepherding the case through an appellate process, re-presenting the case, and then working with vocational experts to determine the support our client would need throughout her life, developing the evidence, some from her treating physicians, to validate the types of support she would need, and then followed by protracted negotiations with the government to secure our client’s compensation package.
While this is a representative case, and not a guarantee of success, it emphasizes that these cases are hard, and it is important to work with attorneys that have the experience to litigate and steer a case through the program from start-to-finish.
